Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and AI Gruvik (“Gruvik,” “we,” “us”) governing your access to and use of our field service management software, including our web application, mobile applications, and related services (together, the “Service”). By creating an account or otherwise using the Service, you agree to these Terms on behalf of yourself and, if you are registering for an organization, on behalf of that organization.

You must provide accurate, current information when creating an account and keep it up to date. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately if you suspect unauthorized use.

The person who creates an organization’s account is its owner and is responsible for the acts of every team member they invite, including that team member’s use of customer data within the Service.

New organizations receive a free trial period, the length of which is shown at signup. No payment method is required to start a trial. At the end of the trial, you must add a valid payment method and select a paid plan to continue using write access to the Service; your data is preserved and remains viewable/exportable if your trial lapses without payment.

Paid subscriptions are billed in advance on a monthly or annual basis through our payment processor, Stripe. Fees are non-refundable except where required by law or expressly stated otherwise. You may cancel at any time; cancellation takes effect at the end of the current billing period.

We may change subscription pricing with at least 30 days’ notice to active subscribers. Continued use of the Service after a price change takes effect constitutes acceptance of the new price.

You agree not to use the Service to:

• Violate any applicable law or the rights of a third party;
• Upload malicious code or attempt to gain unauthorized access to the Service;
• Reverse-engineer or resell the Service without our written consent;
• Store or transmit data you do not have the right to store or transmit; or
• Interfere with the Service’s normal operation or another customer’s use of it.

As between you and Gruvik, you own the customer, job, and business data you upload to the Service (“Customer Data”). You grant us a limited license to host, process, and display Customer Data solely to provide and improve the Service. We do not sell Customer Data.

Certain features rely on third-party processors acting on our instructions, including Stripe and PayPal for payment processing, and Anthropic and OpenAI for AI-assisted features such as the AI assistant and voice transcription. Our Privacy Policy describes this in more detail.

You may export your Customer Data at any time from within the Service, and may request deletion of your account and associated data as described in our Privacy Policy.

You may cancel your account at any time from Settings. We may suspend or terminate an account that materially breaches these Terms, including for non-payment after a trial or billing period ends, with notice where reasonably practicable. Upon termination, your right to use the Service ends, though we will retain Customer Data for a reasonable recovery period as described in our Privacy Policy before deletion.

The Service is provided “as is” without warranties of any kind, express or implied. To the maximum extent permitted by law, Gruvik will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of the Service. Our aggregate liability for any claim arising from these Terms is limited to the amount you paid us in the 12 months preceding the claim.

These Terms are governed by the laws of the jurisdiction in which Gruvik is incorporated, without regard to conflict-of-law principles, unless a mandatory local law gives you additional rights that cannot be waived.

We may update these Terms from time to time. If a change is material, we will notify active account owners by email or in-app notice before it takes effect. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
